Today at 3 PM, Trump’s lawyers will make their case against the temporary removal of the Visa Ban issued by Federal Judge, James Robart (a W. Bush appointee) in the Ninth Circuit Court in San Francisco. This is a rather important day for the rule of law and the equal protection under the law. And no matter how the Court rules, this case will make it to its last stop which is the Supreme Court. The Supreme Court at this point is ideologically tied 4-4, therefore the decision of the Circuit Court will be final.

The Court today can let the temporary stop by Judge Robart stand in which case, after the temporary ban expires in a few weeks, we are back to where we were when this misguided Executive Order was issued. However, at that point we may have a Supreme Court with 9 judges instead of 8.

The Court can issue a decision in support or rejection of the temporary ban which in either case, given the make-up of the Supreme Court, that could become “the law of the land.” In any case, Trump’s Executive Order, as we saw in the faces of the people who were banned from entering the US, has nothing to do with stopping terrorism and everything to do with sloganism and fear mongering.

Just take a moment and look at the people who were banned; A 4-month old Iranian baby requiring emergency heart operation, a 5-yr old Iranian boy, 80-yr old Iranian grandparents, PhD students, green card brides and Iraqi translators who were in the front line of the Iraq war and are true veterans, but without any benefits. And then there are the Syrian Refugees.

Let’s hope that the Circuit Court makes the right decision today.
