Our steemeed contributor Darius Kadivar recently posted a survey entitled:
"Has the Islamic Republic earned it's legitimacy?", which so far 83% have correctly responded with, No.
The problem I am having, is turning my back on the 17% who seem to be confused that the IRI EVER had any legitimacy to begin with.
To put it simply, according to the 1906 Constitution, the Islamic Republic is Illegal, Illegitimate, and anyone who supports it is a Traitor. And one can argue, a stunning Moron.
Hopefully you do not think I am stunning, and allow me to argue that the 1906 Constitution is technically still in play. Primarily because in 1979 it was never legally declared to be dead, and it was simply ignored by Khomeini when he replaced it with his 1979 Islamic (per)version. I will argue that doing so is, according to the 1906 Constitution, illegal.
Why?
Because the 1906 C had/has specific rules by which a majority of the living members of the Majles, faced with the absence of a sitting King/Monarch, can declare the Monarchy abdicated.
(If he was smart) Khomeini should have used this and demand that the remaining sitting Majles members (There were many under equally illegal arrest back then), declare the abdication of the Pahlavi throne, after it was obvious that the Shah had left/fled Iran. (Again).
After Official Abdication was declared, Khomeini could have forced a new election of the Majles, and using his Islam favoring majority of representatives, legally proceed to rewrite the 1906 C in his own likeness (however ulgy that likeness was), and image (however turgid that image was).
Khomeini did not do this. He did not use the the rules of the 1906 C to get what he wanted Legally. Legitimately. Instead being arrogant (ugly and turgid), he thought he would get away with it faster, by holding a referendum, and using that as his authority, put in his Illegal and Illegitimate Constitution.
Unfortunately the Referendum that everyone points to as legitimacy granting power, was a fraud, because the night before the vote, it switched the ballot questions from "Do you want a Democratic Republic?", to "Do you want an Islamic Republic?". This is proven by the publication of the original ballot the days before it, and compared to the actual ballot on the day of the referendum. Using bias and fear induced enforcement by armed Pasdars at the ballot box, they intimidated and coerced the Iranian people with fear into choosing the obvious safer answer.
This "bias of fear and coercion" renders any and all Surveys, or Opinion Polls, or Referendums null and void. The results are statistically invalid. Therefore you cannot use it. Which makes it garbage.
However, before they could use the stacked referendum results to change Iran into an unnatural Islamic State, they broke the law again, by not using the easily understood and even easier implementable provisions of the 1906 C, which would have given them everything they ever wanted. If they were smart. And not ugly and turgid.
Why?
The 1906 Constitution was the Law of the Land.
Ignoring and Breaking the Law of the Land is ILLEGAL.
Anything you do after Breaking the Law of the Land is ILLEGITIMATE.
EPILOGUE
The resulting Islamic Republic is DOUBLY ILLEGITIMATE because it did not use the obvious provisions within the 1906 C to achieve it's ridiculously un-Iranian goals, AND it doubled down on it's sheer repeatedly demonstrated idiocy, by attempting to cheat using the swapped ballot choice in the sham Referendum.
NOTE: Khamenei knew this, which is why in 1989 he replaced the 1979 Islamic Constitution with his "New and Improved Optimized for Better Dictatorship!" model, in which he now has PERMANENTLY secured ALL power to his Holy Supreme Leadership.
But, rewriting an illegitimate Constitution does not make the new one legit.
To render the 1989 C "Unalterable" he removed ALL amendment clauses (so no more majority of Majles rules to change one letter of it), AND he further declared the 1989 C to be a "Perfect Document".
The only other document in existence that has ever been declared to be perfect, is the Qoran. This declaration of the 1989 C as a "Perfect Document" makes ANY suggestion that it is imperfect (never mind outright flawed garbage), a FELONY CRIME.
Which is why no one ever risks the death penalty by questioning it.
Almost no one.
To answer this question, Ask any IRI regime leader and supporter if they can for certain prove the man they call Baba or Abu or Daddy is their real father! The answer will be a big NO!

Have you ever consulted with or had your article peer-reviewed by the world-renowned International law expert Dr. J.D. Esq. letter writer in this site?

All is well but for your information the heir to the peacock throne Reza Joon Pahlavi doesn't believe in the legitimacy of the 1906 constitution anymore ... he even sees flaws in it.
